MaxWarmth – Boiler Installation, Services & E-Commerce Terms & Conditions
1. General & Visual Scope of Works
- 1.1 These Terms and Conditions apply to all quotes, contracts, online store purchases, and physical engineering or installation works provided by MaxWarmth (“the Company”, “we”, “us”) to the customer (“you”).
- 1.2 All visual representations, site descriptions, or layout diagrams provided by you prior to a project must accurately depict the property layout. If the physical site drastically differs from any images, videos, or descriptions provided during the quoting process, we reserve the right to amend the contract price to reflect the true scope of work required.
- 2. Quotes, Surveys, & Structured Payment Terms
- 2.1 Quote Validity: All quotes provided by MaxWarmth for heating installations or property upgrades are valid for 30 days from the date of issue.
- 2.2 Hidden Elements: Our installation quotes are based on a visual inspection or information provided by you. If, upon commencing work, our Gas Safe engineers discover hidden structural defects, legally non-compliant pre-existing pipework, or severe central heating system sludge that could not be reasonably foreseen, we will suspend work. We will provide a revised quote for the additional remedial work required. You are under no obligation to accept the revised quote, but you will be liable to pay for all parts and labour strictly incurred up to the point of suspension.
- 2.3 Upfront Installation Deposit: We require a 50% deposit for all physical engineering materials and boiler units before your installation date can be formally secured and parts ordered from our suppliers. Except where you exercise a valid statutory right to cancel (see Section 6), this deposit is non-refundable once custom materials have been ordered for your property.
- 2.4 Direct Storefront & Express Payment Methods: For online product purchases (including boiler parts, accessories, and wiring harnesses), payment is due immediately at checkout. We accept traditional card networks (Visa, Mastercard, Diners Club), mobile wallets (Google Pay), marketplace accounts (Amazon Pay), and digital payment gateways (PayPal). By processing an order via any “Express Checkout” or “One-Click” features on our storefront, you explicitly authorize the immediate processing of the transaction amount and formally accept these terms in full.
- 2.5 Late Payment Enforcement: MaxWarmth reserves the right to charge interest under the Late Payment of Commercial Debts (Interest) Act 1998 on any bespoke service balances remaining unpaid 7 days after completion. We reserve the right to retain ownership of any uninstalled components until full payment clears through our secure gateway.
3. Logistics, Utilities, & Property Access
- 3.1 Parking Requirements: You must ensure a legal parking space for our engineer’s commercial vehicle within 25 metres of the property entrance. You must arrange and pay for any necessary local council parking permits or visitor vouchers. Any parking fines incurred due to a failure to provide a valid permit will be billed directly to you.
- 3.2 Utility Provision: You must provide our engineers with completely free access to the property on the scheduled dates, alongside uninterrupted, free access to mains water, electricity, and gas necessary to safely install, flush, and test the heating system.
- 3.3 Safe Working Environment: We operate a strict zero-tolerance policy regarding abusive, threatening, or violent behavior toward our staff. If an engineer feels unsafe, they are legally instructed to make the system safe, leave the premises immediately, and terminate the contract. You will remain liable for all materials used and work completed up to that moment.
4. Limitations of Liability & Pre-Existing Systems
- 4.1 Pre-existing Defects: MaxWarmth accepts absolutely no liability for faults, leaks, or component failures that occur in your pre-existing central heating system (such as old radiators, decaying pipework under floorboards, or zone valves) as a result of installing a new high-pressure combi boiler system. High-pressure systems can naturally expose weaknesses in older, low-pressure pipework.
- 4.2 Water Flushes: While we take every precaution when power-flushing or chemically clearing your central heating system, we accept no liability for leaks arising from old radiators or pipework that have been thinned out by pre-existing rust and corrosion.
5. Guarantees: Workmanship vs. Manufacturer
- 5.1 Workmanship Guarantee: MaxWarmth provides a 12-month workmanship guarantee from the date of completion. This exclusively covers faults directly caused by our physical installation (e.g., a leaking joint fitted by our engineer).
- 5.2 Manufacturer Warranty: The mechanical parts inside the boiler itself (e.g., pumps, fans, heat exchangers) are strictly covered by the manufacturer’s warranty (e.g., Worcester Bosch, Ideal, Vaillant). To keep this warranty valid, you must have the boiler serviced annually by a Gas Safe registered engineer. MaxWarmth is not liable if the manufacturer refuses a warranty claim due to your failure to book annual services.
6. Domestic Cancellation Rights (UK Consumer Contracts Regulations)
- 6.1 Right to Cancel: For domestic consumers, you have the right to cancel a service or installation contract within 14 days of signing without giving any reason.
- 6.2 Emergency Bookings: If you explicitly request that we begin installation works before the 14-day cancellation period has expired (e.g., an emergency boiler breakdown in winter), you acknowledge that you waive your right to a full refund. If you cancel after works have started, you must pay a proportional amount for all services and materials supplied up to the time you communicated your cancellation.
7. E-Commerce Sales, Shipping, & Returns (Boiler Parts UK)
- 7.1 Order Acceptance: The display of parts on our website constitutes an invitation to treat. A legally binding contract is only formed when MaxWarmth explicitly processes your payment and dispatches the item. We reserve the right to cancel and refund any order due to stock inaccuracies or pricing errors.
- 7.2 Shipping & Import Duties: UK orders are shipped via standard carrier trackable methods. For international shipments, you are entirely responsible for paying any local import duties, customs clearings, or territorial taxes levied upon arrival. MaxWarmth will not refund shipping costs for items rejected at customs.
- 7.3 Returns & Restocking Fees: In accordance with UK distance selling laws, consumer buyers can return unused, uninstalled parts in their original sealed packaging within 14 days of delivery for a refund. Due to safety risks associated with electrical boiler components, we cannot accept returns on any electrical parts or wiring harnesses if the manufacturer’s security seal or packaging has been opened, broken, or tampered with.
- 7.2 Limitation of Liability (Parts Fitment): MaxWarmth supplies component parts strictly on a parts-only basis. We accept absolutely no liability for any damage to property, personal injury, or boiler breakdown caused by the incorrect installation or DIY fitment of components purchased from our store. We strongly mandate that all gas-carrying or critical electrical parts be installed exclusively by a Gas Safe registered engineer.
